Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Kynd Alchemy website located at kyndalchemy.com (the "Site") and your purchase of Kynd Alchemy products.
Please read these Terms carefully. By using the Site, creating an account, submitting information, placing an order, or purchasing a product, you agree to these Terms, together with any policies incorporated into them by reference.
Plain-language summary
These Terms explain how the Site and our orders work, including pre-orders, shipping, returns, product information, acceptable use, disputes, and important limitations. If you do not agree with these Terms, please do not use the Site or place an order.
1. Acceptance of These Terms
1.1 Agreement to these Terms
By browsing or using the Site, you agree to these Terms. If you place an order, you also agree to the provisions that apply specifically to purchases, including our:
Shipping and Returns; and
Accessibility Statement, when applicable.
These documents are incorporated into and form part of these Terms.
1.2 Browsewrap and clickwrap acceptance
Your continued use of the Site constitutes acceptance of these Terms where the Site provides notice that these Terms apply. When you place an order, you may be required to affirmatively check a box or click a button confirming that you have read and agree to these Terms. That affirmative action constitutes your electronic signature and acceptance of these Terms.
You agree that electronic records, notices, disclosures, and confirmations satisfy any legal requirement that such communications be in writing.
1.3 Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised "Effective date." Unless applicable law requires otherwise, changes will apply prospectively to future use of the Site and future orders.
For material changes, we may provide additional notice by email, through the Site, or at checkout. Your continued use of the Site after the effective date of revised Terms constitutes acceptance of the changes. Changes will not retroactively alter rights or obligations relating to an order already accepted unless required by law or agreed by you.

For purposes of applicable federal cosmetic laws, including the Modernization of Cosmetics Regulation Act of 2022 ("MoCRA"), the responsible person for products whose label bears the Kynd Alchemy name is:

The product label will provide the applicable domestic address, domestic telephone number, or electronic contact information for receiving adverse-event reports.
3. Eligibility and Geographic Availability
3.1 Age
The Site is intended for use by individuals 13 years of age or older. We do not knowingly collect personal information from children under 13. If you are under 18, we recommend using the Site with the involvement of a parent or guardian.
By using the Site, you represent that:
you are at least 13 years old;
all information you provide is accurate and current; and
you will comply with all applicable laws.

3.2 United States orders only
Kynd Alchemy currently accepts and ships orders only within the United States and its territories where delivery is available. We do not currently offer international orders.
We may restrict or refuse delivery to particular locations for legal, logistical, safety, or other legitimate business reasons.
4. Pre-Order Terms
4.1 Pre-launch status
Kynd Alchemy is currently in a pre-launch and product-development phase. Our first product is in development and may be offered for pre-order before final production and launch.
A pre-order is an order placed before the product is available for immediate shipment. A pre-order reserves the product for you, subject to these Terms and product availability.
4.2 Payment at the time of pre-order
Your payment card or other selected payment method will generally be charged when you place the pre-order, not when the product ships. You authorize us and our payment processor to charge the total amount displayed at checkout, including applicable taxes and shipping charges.
4.3 Estimated shipping date
Our current estimated shipping date for the first product is on or before November 1, 2026.
This date is an estimate and not a guarantee. Product development, manufacturing, quality control, supply-chain, regulatory, shipping, or other unexpected circumstances may affect the estimated date.
We will not accept pre-orders unless we have a reasonable basis to believe that the product can be shipped within the timeframe stated at checkout.
4.4 Shipping delays and customer choices
If we learn that we cannot ship your pre-order within the stated timeframe, or within the applicable timeframe required by law, we will provide a delay notice as required by applicable law.
The notice will provide:
a revised, definite shipping date when available; and
the choice to consent to the delay or cancel the affected pre-order for a prompt full refund of amounts paid for merchandise that has not shipped.
We will not treat silence as consent where applicable law requires affirmative consent. If we cannot obtain the required consent, we will cancel the affected order and issue a prompt refund as required by law.
If no shipping timeframe is stated for an order, federal law generally requires a reasonable basis to ship within 30 days, subject to applicable exceptions and requirements.
4.5 Cancellation before shipment
You may request cancellation of a pre-order at any time before it ships by contacting us at [EMAIL] with your order number.
If the pre-order has not shipped, we will cancel it and issue a refund to the original payment method, subject to applicable law and payment-processor timing.
Once an order has shipped, cancellation is no longer available under this section. Any post-shipment return or refund will be governed by the Shipping and Refunds page.
4.6 Discontinued or materially reformulated products
If we discontinue a pre-ordered product before shipment, we will notify you and issue a full refund to the original payment method.
If the product is materially reformulated before shipment in a way that we reasonably believe could affect its identity, intended use, material characteristics, or suitability for customers with sensitivities, we may notify you of the material change and provide a reasonable opportunity to cancel for a full refund before shipment.
A change to packaging, color, texture, manufacturing source, or a minor ingredient adjustment that does not materially affect the product may not constitute a material reformulation. We will publish the final ingredient list before shipment where reasonably practicable.
4.7 Pre-order representations
By placing a pre-order, you acknowledge that:
the product is not immediately available for shipment;
the product is still in development;
product images, packaging, color, texture, and other visual materials may be illustrative;
the final product may differ in non-material ways from pre-launch materials; and
you have reviewed the available product description and ingredient information before ordering.
5. Orders and Order Acceptance
5.1 Order submission
When you submit an order, you are making an offer to purchase the selected products under these Terms. An automated order confirmation confirms that we received your order; it does not necessarily mean that we have accepted the order.
A contract for purchase is formed only when we accept the order, ship the product, or otherwise expressly confirm acceptance, as applicable.
5.2 Right to refuse or cancel orders
We may refuse, limit, or cancel an order for legitimate reasons, including:
product unavailability;
an incorrect price or product description;
suspected fraud or unauthorized activity;
shipping restrictions;
suspected resale or commercial use;
an order that violates these Terms;
quantity limitations;
payment failure; or
an error in processing or inventory.
If we cancel an order after charging you, we will issue a refund for the canceled portion to the original payment method.
5.3 Quantity limits
We may limit the number of products that may be purchased per person, household, address, payment method, account, or order. We may also limit orders that appear intended for resale or commercial distribution without our authorization.
5.4 Pricing errors
We make reasonable efforts to display accurate prices and product information. If we discover a material pricing error before shipment, we may cancel the affected order and refund the amount charged.
If permitted by law and if the correct price is higher, we may contact you and offer the choice to proceed at the correct price or cancel for a full refund.
5.5 Sales tax
Applicable sales tax, use tax, or other transaction-based charges will be calculated and displayed at checkout based on the shipping destination and applicable law.
You are responsible for any taxes that are legally imposed on your purchase but are not collected by us at checkout.
6. Product Information, Ingredients, and Transparency
6.1 Fragrance-free focus
Kynd Alchemy develops personal care products exclusively without added fragrance. "Fragrance-free" means that we do not intentionally add fragrance ingredients for the purpose of scenting the product.
"Fragrance-free" does not necessarily mean that a product has no natural odor, that it is odorless, or that it cannot contain ingredients with an inherent odor. The ingredient list and product-specific labeling control.
6.2 Ingredient lists
We are committed to radical transparency. We intend to publish ingredient information and product details in a clear and accessible manner.
Ingredient lists may be provided on product pages, product packaging, labels, or other product materials. The final product label is the authoritative source for the ingredient list applicable to the purchased product.
6.3 Development changes
Because our products are initially being developed and tested, ingredients, formulas, packaging, and manufacturing processes may change before launch.
We will update the product page and other applicable materials when the final formulation is established. If we make a material change to a pre-ordered product before shipment, Section 4.6 will apply.
6.4 Product images and packaging
Pre-launch photographs, renderings, colors, packaging, labels, and other visual materials are illustrative and may not exactly match the final product.
We will make reasonable efforts to display products accurately, but differences may occur because of screen settings, photography, manufacturing variation, or final packaging decisions.
6.5 No medical claims
Kynd Alchemy products are intended to be cosmetic personal care products. Unless expressly stated on the applicable product label and supported as required by law, our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
7. Sensitivity, Allergy, and Patch-Test Information
7.1 Fragrance-free does not guarantee individual suitability
Although our products are designed without added fragrance and with sensitivity in mind, fragrance-free does not guarantee that a product will be suitable for every person.
Any ingredient may cause irritation, sensitization, allergic reaction, or another unwanted response in an individual. A product may be unsuitable for a person because of a known allergy, an underlying condition, an interaction with another product, or an individual sensitivity.
We do not represent that our products are hypoallergenic, allergy-proof, irritation-free, or incapable of causing a reaction.
7.2 Review ingredients
Before purchasing or using a product, carefully review the complete ingredient list, directions, warnings, and product-specific information.
If you have known allergies, sensitive skin, a dermatological condition, are pregnant or nursing, or have other health concerns, consult a qualified healthcare professional before using a product.
7.3 Patch testing
We recommend performing a small patch test before using a new personal care product broadly. Follow any product-specific patch-test instructions.
A patch test cannot guarantee that a reaction will not occur.
7.4 Stop use if a reaction occurs
Stop using a product and seek appropriate medical care if you experience a concerning reaction. For severe or emergency symptoms, contact emergency services immediately.
Please report product reactions to hello@kyndalche.y.com or (571) 547-4921, including the product name, lot or batch number if available, date of purchase, date of use, description of the reaction, and your contact information.
8. Medical and Health Disclaimer
8.1 No medical advice
Information on the Site, including product descriptions, ingredient information, educational material, blog posts, testimonials, reviews, and other content, is provided for general informational purposes only.
Nothing on the Site constitutes medical, dermatological, pharmaceutical, or other professional advice.
8.2 Cosmetic products, not drugs
Our products are cosmetics as marketed and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Do not rely on Site content as a substitute for advice from a qualified healthcare professional. You should consult your healthcare professional before changing a treatment, using a cosmetic product for a medical purpose, or using a product if you have concerns about a health condition.
8.3 No guarantee of results
Individual experiences and results may vary. Testimonials and reviews reflect the experiences of the individuals who provided them and are not guarantees of typical or future results.
9. Shipping, Delivery, Risk of Loss, and Title
9.1 Shipping and refunds
Shipping charges, available shipping methods, estimated delivery windows, pre-order information, shipping-delay procedures, return eligibility, refund timing, and other shipping- and refund-related terms are described on our Shipping and Returns page.
The Shipping and Refunds page forms part of these Terms.
9.2 Delivery estimates
Carrier delivery dates are estimates and may be affected by weather, carrier disruptions, address errors, holidays, supply-chain issues, or other circumstances outside our reasonable control.
The pre-order shipment commitment and delay procedures in Section 4 apply to the extent they differ from ordinary delivery estimates.
9.3 Accurate delivery information
You are responsible for providing a complete and accurate delivery address. If an order is returned because of an incorrect or incomplete address, we may contact you regarding available options and any additional shipping charges.
9.4 Risk of loss and title
To the fullest extent permitted by applicable law, title to and risk of loss for a product pass to you upon delivery to the shipping address you provided.
If a shipment is lost, damaged, or materially delayed before delivery, contact us at hello@kyndalchemy.com. We will make reasonable efforts to assist with the carrier claim or other appropriate resolution, consistent with the Shipping and Refunds page.
Nothing in this Section limits rights that cannot be waived under applicable consumer law.
10. Returns, Refunds, and Exchanges
10.1 Shipping and Refunds page
Our Shipping and Refunds page is available at Shipping and Returns and forms part of these Terms.
The Shipping and Refunds page explains:
shipping charges, methods, and delivery estimates;
shipping-delay procedures and pre-order shipping information;
the applicable return window;
eligible and ineligible products;
treatment of opened or used personal care products;
the special process for skin reactions or allergies;
damaged, defective, incorrect, or missing products;
return shipping responsibility;
refunds, exchanges, and store credit; and
any applicable exceptions.
10.2 Product-safety considerations
Because personal care products may be applied to the body, we may not be able to restock or resell products that have been opened or used.
We will apply the Shipping and Refunds page consistently and will not use hygiene restrictions to limit rights that cannot legally be waived, including rights relating to defective, misdescribed, or unsafe products.
10.3 Consumer rights preserved
Nothing in these Terms or the Shipping and Refunds page limits any non-waivable consumer rights under applicable law.
11. Intellectual Property
11.1 Kynd Alchemy content
The Site and its contents, including names, logos, trademarks, product names, text, graphics, photographs, illustrations, videos, software, design, layout, and other materials, are owned by or licensed to Kynd Alchemy and are protected by intellectual-property and other applicable laws.
"Kynd Alchemy," related logos, product names, taglines, and other marks are trademarks or trade dress of Kynd Alchemy LLC or its licensors. You may not use them without prior written permission.
11.2 Limited license
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for your personal, non-commercial purposes.
This license does not permit you to:
copy, reproduce, republish, distribute, sell, lease, or exploit Site content;
modify or create derivative works from the Site;
use data-mining, scraping, robots, or similar automated tools;
frame or mirror the Site;
remove copyright, trademark, or other proprietary notices;
use the Site or its content to develop a competing service; or
use Kynd Alchemy marks in a manner that implies endorsement or affiliation.
All rights not expressly granted are reserved.
12. User Content, Reviews, and Testimonials
12.1 User submissions
The Site may allow you to submit reviews, comments, photographs, videos, testimonials, feedback, questions, or other content ("User Content").
You are responsible for your User Content and represent that:
it is truthful and based on your actual experience;
you have the rights necessary to submit it;
it does not violate another person's privacy, intellectual-property, or other rights;
it does not contain unlawful, threatening, abusive, defamatory, obscene, or fraudulent material;
it does not include malware or harmful code; and
it complies with applicable law and these Terms.
12.2 License to Kynd Alchemy
By submitting User Content, you grant Kynd Alchemy and its affiliates, contractors, service providers, successors, and licensees a worldwide, royalty-free, non-exclusive, transferable, sublicensable, perpetual, irrevocable license to host, reproduce, modify, adapt, publish, translate, distribute, display, perform, and otherwise use the User Content for operating, improving, marketing, and promoting Kynd Alchemy and its products.
We may use your name, username, image, likeness, or other identifying information only as permitted by applicable law and our Privacy Policy or with any required consent.
12.3 Reviews and incentives
Reviews must reflect the honest opinions, findings, beliefs, or experiences of the reviewer.
You may not:
submit a review for a product you did not use or purchase;
submit or procure fake, fabricated, AI-generated, or materially misleading reviews;
provide or accept compensation conditioned on a particular positive or negative sentiment;
impersonate another person;
review your own business or products without a clear disclosure of the relationship;
threaten or pressure anyone to provide a particular review;
manipulate ratings or review results; or
submit the same review repeatedly.
If we provide a free product, discount, compensation, sample, entry, or other benefit in connection with a review or testimonial, any required material-connection disclosure must be clear and conspicuous.
We may moderate, reject, remove, or refuse to publish User Content that we reasonably believe violates these Terms, applicable law, a platform rule, or our content standards. We will not remove a review merely because it is negative or critical, provided it is genuine and otherwise compliant.
13. Acceptable Use
You may use the Site only for lawful purposes and in accordance with these Terms.
You may not:
violate any applicable law, regulation, or third-party right;
use the Site to commit fraud, abuse, harassment, or deception;
interfere with the operation, security, or availability of the Site;
attempt to gain unauthorized access to accounts, systems, or data;
introduce viruses, malware, or harmful code;
scrape, crawl, harvest, or collect information from the Site without written permission;
use another person's account, identity, payment method, or information without authorization;
resell or commercially distribute products without authorization;
submit false orders, reviews, or complaints;
use automated purchasing or checkout tools;
circumvent quantity limits, security measures, or access restrictions;
use the Site to send spam or unauthorized marketing communications;
reverse engineer, decompile, or disassemble any Site technology except to the extent such restriction is prohibited by law; or
encourage or assist anyone else to do any of the foregoing.
14. Disclaimers of Warranties
14.1 "As is" disclaimer
To the fullest extent permitted by law, the Site, its content, and products are provided on an "as is," "as available," and "with all faults" basis, without warranties of any kind, express, implied, or statutory, except for warranties that cannot legally be excluded.
To the fullest extent permitted by law, Kynd Alchemy disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and warranties arising from course of dealing or usage of trade.
14.2 No guarantee of uninterrupted Site access
We do not warrant that:
the Site will be uninterrupted, timely, secure, or error-free;
the Site or its servers will be free from viruses or other harmful components;
information on the Site will always be complete, accurate, or current;
products will always be available; or
the Site will meet every individual requirement or expectation.
14.3 Product and sensitivity limitations
We do not warrant that a product will be suitable for every person, prevent a reaction, be hypoallergenic, or produce a particular result.
Nothing in these Terms excludes or limits any warranty, remedy, or right that cannot be excluded or limited under applicable law.
15. Limitation of Liability
15.1 Excluded damages
To the fullest extent permitted by law, Kynd Alchemy and its owners, officers, employees, contractors, affiliates, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption, arising out of or relating to:
the Site;
these Terms;
an order or product;
the inability to use the Site or a product; or
any content, communication, or transaction connected with Kynd Alchemy.
15.2 Liability cap
To the fullest extent permitted by law, Kynd Alchemy's total liability for all claims arising out of or relating to the Site, these Terms, or a product will not exceed the greater of: the amount you paid to Kynd Alchemy for the product or service giving rise to the claim during the six months before the event giving rise to liability.
15.3 Non-waivable rights and personal injury
Nothing in these Terms excludes or limits:
liability that cannot legally be excluded or limited;
rights or remedies that cannot legally be waived;
liability for fraud or fraudulent misrepresentation;
liability for willful misconduct; or
liability for personal injury or death caused by negligence where such liability cannot lawfully be limited.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the exclusions and limitations apply only to the extent permitted by law.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Kynd Alchemy, Kynd Alchemy LLC, and their respective owners, officers, directors, employees, agents, affiliates, contractors, licensors, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
your use or misuse of the Site or products;
your breach of these Terms;
your User Content;
your violation of applicable law or a third-party right; or
your fraud, negligence, or willful misconduct.
We reserve the right to assume exclusive control of the defense of any matter subject to indemnification. You agree to reasonably cooperate with that defense.
This indemnification obligation does not apply to the extent that a claim arises from Kynd Alchemy's own conduct for which indemnification is prohibited by applicable law.
17. Dispute Resolution
17.1 Contact us first
If you have a problem with an order or product, email us first at hello@kyndalchemy.com and we will try to resolve it directly. The Shipping and Returns page and our satisfaction promise are the first route for product concerns.
17.2 Reasonable opportunity to resolve
We ask that you give us a reasonable opportunity to resolve the issue before taking any formal action.
17.3 Court claims (including small claims)
If we cannot resolve it between us, either you or Kynd Alchemy may bring a claim in court.
Nothing in these Terms prevents you from bringing an individual claim in small claims court if it qualifies.
18. Governing Law and Venue
These Terms and any dispute will be governed by the laws of the State of Virginia, without regard to conflict-of-law principles.
Any court proceeding must be brought in the state or federal courts located in Fairfax County, VA, and you consent to the jurisdiction and venue of those courts.
This Section does not deprive you of any mandatory consumer protections or rights provided by the law of your state of residence.
19. Suspension and Termination
We may suspend or terminate your access to the Site, cancel orders, or restrict future transactions if we reasonably believe that:
you violated these Terms;
your use presents a security, legal, or fraud risk;
your conduct may harm Kynd Alchemy or another person;
a payment was unauthorized or fraudulent; or
suspension is necessary to comply with law or protect the Site.
You may stop using the Site at any time.
Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, User Content, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and payment obligations.
20. General Terms
20.1 Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be modified or severed only to the minimum extent necessary. The remaining provisions will remain in effect.
20.2 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent.
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or operation of the business.
20.3 Entire agreement
These Terms, together with the policies and documents incorporated by reference, constitute the entire agreement between you and Kynd Alchemy concerning the Site and purchases made through it, except for any separate written agreement expressly entered into by the parties.
20.4 No waiver
Our failure to enforce a provision of these Terms is not a waiver of our right to enforce that provision later.
20.5 Force majeure
We are not responsible for delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, government action, utility failure, internet or technology failure, transportation disruption, supplier failure, manufacturing disruption, or carrier delay.
This Section does not excuse obligations that cannot legally be excused, including legally required refunds or consumer notices.
20.6 No third-party beneficiaries
These Terms do not create rights for any third party, except where expressly stated.
20.7 Headings
Headings are provided for convenience and do not affect the meaning or interpretation of these Terms.

21.2 Adverse-event reporting
Consumers may report an adverse event, suspected product reaction, or product-safety concern to Kynd Alchemy at:

When contacting us, please provide the product name, lot or batch number if available, date purchased, date used, description of the event or reaction, and your preferred contact information. Please retain the product and its packaging where possible.
Under MoCRA, the responsible person must submit a serious adverse-event report to the U.S. Food and Drug Administration within 15 business days after receiving the required information. New medical information received within one year may also require submission within 15 business days.
